Acceptable Use Policy

This policy outlines the permitted and prohibited uses of GuestPass Plus. All users must comply with this policy to ensure a safe and effective platform for everyone.

1. Overview

This Acceptable Use Policy ("AUP") describes the permitted and prohibited uses of GuestPass Plus services (the "Services"). This AUP is incorporated by reference into our Terms of Service and applies to all users of our platform, including clubs, staff, members, and guests.

We may modify this AUP at any time by posting a revised version on our website. By continuing to use the Services after any modification, you agree to the updated policy. Violations of this AUP may result in suspension or termination of your access to the Services.

2. Permitted Use

You may use GuestPass Plus for the following lawful purposes:

  • Managing guest registrations, waivers, and check-ins at your club or venue
  • Issuing digital guest passes to authorized visitors
  • Tracking guest activity and generating analytics for your organization
  • Sending transactional communications related to guest visits
  • Sending marketing communications to guests who have opted in
  • Managing member referral programs for guest invitations
  • Organizing events and managing registration/capacity
  • Training staff on the use of the platform
  • Integrating with authorized third-party systems for data synchronization

3. Prohibited Activities

You agree NOT to use the Services for any of the following purposes:

3.1 Illegal or Harmful Activities

  • Any activity that violates applicable laws or regulations
  • Fraud, identity theft, or misrepresentation
  • Money laundering or financing of terrorism
  • Activities that promote violence or harm to individuals
  • Discrimination based on race, religion, gender, sexual orientation, disability, or other protected characteristics
  • Human trafficking or exploitation

3.2 Spam and Abuse

  • Sending unsolicited bulk messages (spam) via email or SMS
  • Sending messages to individuals who have not consented to receive them
  • Using the Services to harvest email addresses or phone numbers
  • Circumventing opt-out mechanisms or ignoring unsubscribe requests
  • Sending messages with deceptive headers or misleading subject lines
  • Using the Services for phishing or social engineering attacks

3.3 Unauthorized Access

  • Attempting to access accounts, systems, or data without authorization
  • Using credentials belonging to another user without permission
  • Circumventing security measures, access controls, or authentication systems
  • Testing the vulnerability of our systems without written permission
  • Accessing data of other tenants on the platform

3.4 Platform Abuse

  • Using automated tools (bots, scrapers, crawlers) without authorization
  • Overloading the Services with excessive requests or denial-of-service attacks
  • Interfering with other users' access to or use of the Services
  • Attempting to reverse engineer, decompile, or extract source code from the Services
  • Reselling or redistributing the Services without authorization
  • Using the Services to develop competing products

3.5 Misuse of Guest Passes

  • Creating fake guest profiles or registrations
  • Using guest passes for unauthorized purposes
  • Transferring or selling guest passes to third parties
  • Generating passes for individuals not actually visiting the facility
  • Using the waiver system to collect signatures for unrelated documents

4. Content Standards

All content you upload, transmit, or create using the Services must comply with the following standards:

4.1 Waiver Content

Custom waiver text must:

  • Be legally valid and enforceable in your jurisdiction
  • Accurately describe the risks and liability terms
  • Not contain deceptive or misleading statements
  • Not include terms that violate applicable consumer protection laws
  • Be reviewed by legal counsel for your organization

4.2 Branding and Marketing Content

Logos, images, and marketing materials must:

  • Not infringe on third-party copyrights, trademarks, or intellectual property
  • Not contain obscene, defamatory, or objectionable content
  • Not make false or misleading claims
  • Comply with applicable advertising standards and regulations

4.3 Communications

Email and SMS messages sent through the platform must:

  • Accurately identify the sender
  • Include a valid physical address
  • Include clear opt-out instructions for marketing messages
  • Not contain malware, viruses, or malicious links
  • Comply with CAN-SPAM, TCPA, and other applicable regulations

5. System Integrity

You must not take any action that could harm the integrity or performance of our systems:

  • Do not introduce viruses, worms, trojans, or other malicious code
  • Do not attempt to overwhelm our infrastructure with excessive requests
  • Do not exploit security vulnerabilities (report them to us instead)
  • Do not access systems, data, or files outside your authorized scope
  • Do not modify, delete, or corrupt data belonging to other users
  • Do not interfere with backups, logging, or monitoring systems

If you discover a security vulnerability, please report it responsibly to security@guestpassplus.com. We appreciate responsible disclosure and will work with you to address any issues.

6. Data Accuracy

You are responsible for ensuring the accuracy of data you submit to the Services:

6.1 Customer Responsibilities

  • Provide accurate club and organization information during setup
  • Maintain up-to-date contact information for your account
  • Ensure member data imported to the platform is accurate
  • Correct any errors in your data promptly when discovered

6.2 Guest Responsibilities

  • Provide your real name and accurate contact information during registration
  • Do not impersonate another person or provide false identity information
  • Update your information if it changes

7. Compliance with Laws

You must comply with all applicable laws and regulations when using the Services, including but not limited to:

  • Privacy laws (CCPA, CPRA, GDPR, and other applicable privacy regulations)
  • Anti-spam laws (CAN-SPAM Act, TCPA for SMS)
  • Consumer protection laws
  • Export control laws
  • Anti-discrimination laws
  • Employment and labor laws
  • Health and safety regulations
  • Data protection and security laws

You are solely responsible for ensuring your use of the Services complies with laws applicable to your organization and jurisdiction. GuestPass Plus is not responsible for your compliance with such laws.

8. Enforcement

We take violations of this Acceptable Use Policy seriously. Our response to violations may include:

8.1 Investigation

We may investigate any suspected violation of this AUP. During an investigation, we may temporarily suspend your access to the Services to prevent further harm.

8.2 Consequences

Depending on the severity and nature of the violation, we may:

  • Issue a warning requiring you to cease the prohibited activity
  • Temporarily suspend your access to the Services
  • Permanently terminate your account
  • Remove or disable access to violating content
  • Report the violation to law enforcement or regulatory authorities
  • Pursue legal action for damages or injunctive relief

8.3 Repeat Violations

Repeat violations will be treated more severely. We reserve the right to permanently ban users who repeatedly violate this AUP or who commit severe violations.

8.4 No Refunds

If your account is terminated due to a violation of this AUP, you will not be entitled to any refund of prepaid subscription fees.

9. Reporting Violations

If you become aware of any violation of this Acceptable Use Policy, please report it to us promptly:

When reporting a violation, please include as much detail as possible, including:

  • Description of the violation
  • Any relevant evidence (screenshots, URLs, email headers)
  • The date and time of the violation
  • The identity of the violator, if known

We will investigate all reports and take appropriate action. We may contact you for additional information during our investigation.
